Intellectual Property

The copyright and trademark rights of POMMIER and the website www.pommier.eu are protected under French and international laws relating to intellectual property.

POMMIER retains ownership of all intellectual property rights over photos, illustrations, drawings, models, plans, documents, etc. The logos and trademarks are the property of POMMIER, except those which are the exclusive property of the commercial partners featured on the website.

The Customer shall therefore refrain from any reproduction or exploitation, without the prior express, written consent of POMMIER.
Any total or partial reproduction of this content in an illegal manner that has not been authorised by POMMIER is strictly prohibited, and if necessary, the latter reserves the right to take legal action with the competent legal and/or police authorities.

The website offers POMMIER customers the possibility of downloading product documents, via a secure connection (plans, instructions, approvals, etc.). The customer undertakes, in particular by checking the "I commit not to distribute or reproduce documents available for private access on my account" box, only to use it for private purposes and not to disclose it to any third party.

Personal Data Protection

POMMIER, as the Data Controller, implements dedicated processing operations for its customers, in particular to enable them to find out the price and availability of products and to pre-order them.
The data collected concerns:

  • Personal data, through the completion of forms: pre-order, quotation, customer account (surname, first name, delivery address, email address, telephone number) to register pre-orders and ship them.
  • Browsing information (IP address, type of browser, type of device) to simplify the customer experience and continue to improve the experience (compilation of statistics).

The data can only be accessed by authorised staff and service providers authorised to carry out the tasks specified above.

Retention of Data Collected

Personal Data associated with the customer account (surname, first name, product or service, delivery address, invoicing address, etc.) is retained for a period of three years from the last date of contact with POMMIER.

The data can be accessed by the customer and by POMMIER, in particular via his/her customer account, in order to allow him/her to have access to his/her information at any time.

POMMIER undertakes to erase the data at any time on request.

However, at the end of this period, including from the date of the erasure request, the Personal Data may be subject to intermediate Archiving. This is in order to comply with the legal, accounting and tax obligations incumbent on POMMIER, such as the obligation to retain accounting documents and supporting documents (invoices, purchase orders, etc.) for a period of ten years.

After these deadlines, the data is erased.

Commercial Prospecting: Sales Offers, Newsletters, Competitions, Products, Services, News

POMMIER seeks the agreement of its customers and prospects to send sales offers, newsletters, competitions, products, services and news by email or similar means, post and telephone.

The agreement of the customer or prospect is obtained by checking the box "I commit not to distribute or reproduce documents available for private access on my account" when his/her account is created.

This consent may be withdrawn at any time by the customer or prospect.

Right to Object, Modify, Rectify, Erase and Access Personal Data

Customers and prospects can at any time, free of charge: "unsubscribe " from receiving marketing materials, by clicking on the link in each email; modify their personal information using the "my account " section.

Pursuant to Law 78-17 of the 6th January 1978 as amended, and European Regulation 2016/679 and Directive 2016/680 of the 27th April 2016, which entered into force on the 25th May 2018, customers and prospects have the right to access, modify, rectify, erase, limit processing and object to any information concerning them.

To be able to exercise this right, please send us your request in the following manner:

  • by email to dpo@pommier.eu, indicating your first name and surname, postal address and email address and write as the subject of the email "POMMIER Website: Modification of Personal Data"
  • by post accompanied by proof of identity or a POMMIER invoice to the address: POMMIER, Bâtiment B, 6 chemin de Pontoise à Saint-Prix, 95250 Beauchamp - FRANCE, with the subject of the letter being "POMMIER Website: Modification of Personal Data "

We will send you a reply within one month of the date of receipt of your request. In some cases, due to the complexity of the request or the number of requests, this time limit may be extended by two months.
